No Common Law Rights in Patents.

Rights in a patent are only for the life of a patent which remains granted and has not been revoked. The manner in which patent rights operate is that they are merely statutory rights and there are no common law rights in patents. Patent infringement actions are maintainable only in respect of granted and live patents.

Trademarks Rules, 2017

The Trade Marks Rules, 2017 has been published by the Government of India, Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) by notification dated 06/03/2017 in Part II, Section 3, Sub-Section (ii) of the Gazette of India, Extraordinary and has been made effective from the date of publication i.e. 06/03/2017.
