High Court of Delhi Rules for Video Conferencing for Courts 2020.
The Hon’ble Delhi High court notified the “High Court of Delhi Rules for Video Conferencing for Courts 2020” that came into force from 01/06/2020. The said Rules shall apply qua the High Court of Delhi and vis-à-vis courts and tribunals over which this Court has jurisdiction.
Documents ought to be necessarily filed along with the plaint in Trademark Infringement matters.
In order for the Court to consider the registration, documentary evidence in the form of either the trademark registration along with the journal extracts or the Legal Proceeding Certificate ought to be placed on record.
No Common Law Rights in Patents.
Rights in a patent are only for the life of a patent which remains granted and has not been revoked. The manner in which patent rights operate is that they are merely statutory rights and there are no common law rights in patents. Patent infringement actions are maintainable only in respect of granted and live patents.
Trademarks Rules, 2017
The Trade Marks Rules, 2017 has been published by the Government of India, Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) by notification dated 06/03/2017 in Part II, Section 3, Sub-Section (ii) of the Gazette of India, Extraordinary and has been made effective from the date of publication i.e. 06/03/2017.
