The Patents (Amendment) Rules, 2020 have been published by the Government of India, Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) by notification dated 20/10/2020 in the Gazette of India, and has been made effective from the date of publication i.e. 20/10/2020. The said rules are available on the official website of the Office of Controller General of Patents, Designs and Trade Marks www.ipindia.nic.in.
Some salient features of the Amended Rules are as follows:
The statement regarding the working of PATENTED INVENTION(S) ON A COMMERCIAL SCALE IN INDIA shall be furnished by the Patentee(s)/Licensee once in respect of every financial year, starting from the financial year commencing immediately after the financial year in which the patent was granted, and shall be furnished within six months from the expiry of each such financial year.
In THE SECOND SCHEDULE, an amended Form 27 for filing of statement regarding the working of patented invention(s) on a commercial scale in India has been substituted.
