The Copyright (Amendment) Rules, 2021

The Copyright (Amendment) Rules, 2021 have been published by the Government of India, Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade) by notification dated 30/03/2021 in the Gazette of India, and has been made effective from the date of publication i.e. 30/03/2021. The said rules are available on the official website of the Copyright Office at https://copyright.gov.in/.

Some salient features of the Amended Rules are as follows:

1. in Rule 2 (1) (b), for the words “a Copyright Board” the words “the Appellate Board” shall be substituted; and in Chapter II, for the title “THE COPYRIGHT BOARD” the title “THE APPELLATE BOARD” shall be substituted.

2. in Rule 70(5), for the words “the source and object code”, the words “at least first 10 and last 10 pages of source code, or the entire source code if less than 20 pages, with no blocked out or redacted portions” shall be substituted.

Rule 70(5): Every Application for registration of a computer programme shall be accompanied by at least first 10 and last 10 pages of source code, or the entire source code if less than 20 pages, with no blocked out or redacted portions.”

3. in SECOND SCHEDULE, in serial 9 and 10, in clause (b), the word “Literary or” shall be Omitted and after the word “goods”, the words “or services” shall be substituted.

Serial No. 9 and 10, Clause (b): Provided that in respect of an Artistic Work which is used or is capable of being used in relation to any goods or services (section 45).”

4. in SECOND SCHEDULE, serial number 19 and the entries relating thereto shall be Omitted.
